“The attorney’s duty of confidentiality (Section 43a BRAO) and the notary’s duty of secrecy (Section 18 BNotO), together with the GDPR, impose strict requirements on the security of client data. Law firms that transmit pleadings, deeds, or client files via unencrypted email or US cloud services risk professional disciplinary consequences and a breach of the GDPR.”

TeamDrive stores all data end-to-end encrypted on servers in Germany – with a zero-knowledge architecture that prevents even TeamDrive itself from accessing client data.

Legal Requirements for Cloud Use by Law Firms and Notary Offices

Section 43a BRAO obliges attorneys to maintain confidentiality about everything that becomes known to them in the course of their professional practice. For notaries, Section 18 BNotO establishes a comparable duty of secrecy that continues even after their term of office ends. Since the 2017 BRAO reform, Section 43e BRAO governs the conditions under which attorneys may engage external service providers such as cloud providers: careful selection, a contractual confidentiality obligation for the provider, and access limited to what is necessary.

The use of US cloud services is therefore generally incompatible with this, since US authorities can access data stored there belonging to European customers under the CLOUD Act.
